Do you need to register an empty rental property?
Last checked 17 Oct 2026. The regulations were still in draft when we checked, so details can change.
A property between tenants, or one you are renovating, raises an obvious question about the register.
What GOV.UK says
The Housing Hub says that if you have unoccupied properties, you do not need to register them yet. It says you will get further guidance before marketing them for let. It also says that, for now, only properties that are let, or that become let during the rollout, must be registered. See who has to register.
When an empty property becomes let
The draft regulations expect tenancy and safety information within 28 days of a tenancy starting. If you register a property that is not let and then let it, put that date in your diary. See updating and renewing your entry.
Marketing a property
Official sources say a relevant property cannot be advertised or let while the entry is inactive. See what happens if you do not register. Further guidance on marketing empty properties is still to come, so check GOV.UK before you advertise.
What to do now
List your empty properties separately, with the region and the expected let date for each, so you can act quickly when guidance arrives. The Dateledger Planner has a "Will be let soon" status for this.
